Biography

Jodie represented her first capital client forty-one years ago. For the past 31 years she has been in private practice in Indianapolis handling death penalty cases – at times as a trial defender, a mentor or expert witness in post-conviction proceedings or, as a capital mitigation specialist or jury consultant. She has mitigated capital cases in Colorado, Indiana, Kentucky, Michigan, Oklahoma and Ohio. Last fall, she served as lead counsel in a penalty phase retrial and got her client, who had spent 21 years on Indiana’s death row, a sentence of 110 years. Earlier this year she was the mitigation specialist for another client who spent 20 years on Indiana’s death row and is now serving two life sentences. Her testimony as an expert witness on ineffective assistance of counsel resulted in the Seventh Circuit’s grant of a penalty phase retrial for in 2018.

From 1998 – 2009, in addition to lawyering, Jodie was the part-time Training Director for the Indiana Public Defender Council. Jodie has served as a faculty member for the National Criminal Defense College (NCDC) summer Trial Practice Institutes since 1981, for NCDC’s advanced programs in Cross Examination, Theories and Themes of Persuasion, Voir Dire and Closing Argument; and capital trial advocacy programs including Life in the Balance, the Darrow Death Penalty College, and the Bryan Schechmeister Death Penalty College in San Jose, California. Jodie has taught thousands of criminal defense lawyers, social workers or mitigation specialists in twenty-seven states and was part of a team invited to Moscow to facilitate the Russians’ transition from three judge panels to juries. Jodie was a “Super Lawyer” for seven years. Writing and storytelling are special passions. In 2014 Jodie earned an MFA in Creative Writing from Butler University.

Jodie’s son Ben is an artist and freelance journalist and her daughter Cady works for Salesforce in Colorado and is an avid climber of 14’er’s. In her spare time Jodie writes poetry, jogs, kayaks, camps, hikes and reads. Her first grandson, Sovann, was born in Cambodia on the Fall Equinox and now lives with her and his parents, disrupting their sleep cycles with exquisite precision and yet his smile, on waking, is poetry itself.

Biography

Richard Kammen is a criminal defense lawyer with his office in Indianapolis, Indiana. He concentrates his practice in serious felonies, white-collar defense, complex crimes and death penalty defense. He is of Counsel to the law firm of Kammen and Moudy.  He graduated from Ripon College cum laude in 1968 and New York University School of Law in 1971.  Admitted to the Bar in 1971, he began his practice after service in the United States Army.

During his professional career, Mr. Kammen has served as a public defender in the Marion County Courts on two occasions, 1972-1974 and 1978-1979.

Mr. Kammen has represented clients charged with offenses ranging in seriousness from felony drunk driving to Racketeering and Capital Murder.

Mr. Kammen has defended over three hundred homicide cases including approximately forty death penalty cases in both State and Federal courts. No client that Mr. Kammen has represented at trial has been sentenced to death.  Mr. Kammen has been trial counsel on six State death penalty cases, including State of Indiana v. Charles Smith, a retrial of a reversed death penalty conviction in which the defendant was found not guilty. He has been appointed by United States District Judges to represent capitally charged defendants throughout the United States including such cases as United States v. Raymond Cheely (Government’s request for death penalty dismissed as improper) United States v. Reginald Brown (Government’s request for death penalty and underlying Murder charges dismissed because the defendant is innocent) , United States v. Joe Minerd, in which the defendant, convicted of killing his pregnant girlfriend and her three year old with a bomb received a life sentence. He was appointed “learned counsel” in United States v. Donnell Young, which was, until it was resolved by a plea the longest Federal capital case pending in the United States..  Mr. Kammen was appointed as “learned counsel” in the Federal capital case, United States v. Timothy O’Reilly. Mr. O’Reilly received a life sentence after a trial lasting three months. He was lead counsel on the defense team that represented David Camm who was exonerated and freed  by acquittal, after being imprisoned for thirteen years, and two prior convictions of killing his wife and two children.

Until October of 2017, Mr. Kammen served as “Learned Counsel” in United States v. Abdul Rahim Al-Nashiri who is charged before a Military Commission at Guantanamo Bay Cuba. Al-Nashiri is alleged to have been a central figure in the bombing of the U.S.S. Cole in 2000 in Aden, Yemen. This is likely to be the first capital military commission. Mr. Kammen and other Civilian counsel withdrew from the case after the Commission refused to address possible intrusions into the attorney client relationship.

A frequent speaker and lecturer on criminal defense issues, Mr. Kammen has spoken in almost every state and federal circuit.  He has been a member of the faculty of the National Criminal Defense College since 1982 and the Trial Lawyers College since 2001.

Mr. Kammen is the recipient of the Pro Bono Award given by the Indiana Bar Association and a Lifetime Achievement Award from the Indiana Public Defender Council.

Biography

David started his career as a Death Penalty mitigation specialist and post-conviction relief lawyer at the Indiana State Public Defender. He has represented thousands of clients in cases from misdemeanor to murder, and as lead counsel, has represented clients in more than 120 jury trials and hundreds of bench trials as a trial deputy at the Marion County Public Defender Agency in Indianapolis. IN 2015 he was hired to become the Chief Public Defender of Lawrence County in Bedford, Indiana where he transformed the way the County dealt with drug charges, shifting the primary focus to treatment. IN 2020, he opened his own law office; Shircliff Law, focused on criminal defense and trial coaching.

David has an MSW and is a nationally recognized trainer, teacher and coach in the areas of criminal defense, trial skills and dealing with secondary trauma. He is passionate about creating new, transformative, hands on workshops that empower defenders to create strong client relations, to hone their trial skills, and to have fulfilling lives outside of criminal defense, by recognizing and effectively combatting the personal, psychological and emotional toll caused by the trauma of doing this work.

He teaches Trial Practice at the I.U. Mckinney School of Law in Indianapolis. He has been a faculty member of the Trial Practice Institute in Indiana, and has been trained by Gerry Spence at the Trial Lawyers College in Dubois, Wyoming.
